Section 0 - Definition & Confirmation of Contract Terms
The words ‘The Company’ refer to Designer Living Group Ltd T/A Designer Living.
Section 1 - Base & Foundations - 5 Year Guarantee
Should any fault appear in any Base & Foundations laid by The Company within 5 years from the date of installation, due to defective materials or workmanship, the company will repair or replace the faulty product free of charge as part of this guarantee.
Section 2 - uPVC Frames - 10 Years Guarantee
Should any fault appear in any product installed by The Company within 10 years from the date of installation, due to defective materials or workmanship, the company will repair or replace the faulty product free of charge.
This guarantee is subject to condition 3a-3b of the company’s terms and conditions, and the customer’s attention is particularly drawn to the requirement to comply with the company’s cleaning instructions which appear on the reverse of this document. Any repair work carried out or replacement units supplied within the 10 year guarantee period under the terms of this guarantee will also be covered by the companies undertaking, but only for the portion still remaining of the 10 year guarantee period.
Section 3 - Sealed Units - 5 Years Guarantee
Should any fault appear in any sealed unit supplied by The Company within 5 years from the date of installation, due to defective materials or workmanship, the company will repair or replace the Faulty sealed unit free of charge. This guarantee is subject to condition 3 of the company’s terms and conditions, and the customer’s attention is particularly drawn to the requirement to comply with the companies cleaning instructions.
Section 4 - Sealed Unit Repairs - 5 Year Guarantee
Any repair work carried out by The Company or replacement units supplied by the company within the 5 year guarantee period under the terms of this guarantee will also be covered by the company’s undertaking, but only for the portion still remaining of the 5 year guarantee period.
Section 5 - Supalite / Tiled Roofs - 10 Year Guarantee
All our Superlite Roofs come with a Manufacturers Roof Guarantee. This covers the Life Expectancy of the Tiles so you can be sure that you’ve bought a robust, well designed, precision-made product that’s built to last. There’s even a warranty on tiles of up to 50 years*. *Dependant on Tile Type, some tiles have a different life expectancy.
Section 6 - EPDM Membrane Material Warranty
In the event any leak should be discovered in the membrane, the owner must give written notice to the seller (The Company) within thirty (30) days if deterioration of the membrane is suspected as the cause of the leak. By so notifying the seller, the owner authorises the seller or its designee to inspect the membrane to determine the cause of same. In the event that the seller reasonably determines that deterioration was caused by a defect in the actual membrane or manufacturing of the membrane, the sellers liability shall be limited to the labour and membrane costs to repair the leak.
To the extent that any damages are due to acts of God, natural disasters (including, but not limited to,) winds, hurricanes, lightning, tornadoes and earthquakes, negligence, abuse, vandalism, repairs or alterations or attachments to the project, or war or civil disobedience and/or do not directly arise from any defect in material or manufacturing workmanship, such damages are excluded from coverage under this warranty.
The seller will charge a reasonable inspection fee to cover time and travel which is fully refundable should the leak be determined to have been caused by a defect in the material or material manufacturing workmanship.
This is not an EPDM system installation warranty. This should be provided independently by the installer. This warranty refers to the membrane only. Flashings, adhesives, and other accessories contained in the membrane system are not covered by this warranty. No representative of the seller has authority to make any representation or promises except as stated herein.
There are no warranties either expressed or implied, including the implied warranties of merchantability and fitness for a particular purpose, which extend beyond the warranties contained in this document. The seller shall not be liable for any incidental, consequential or other damages, including but not limited to loss of profits or damages to the structure or its contents arising under any theory of law whatsoever.
Section 7 - Roof Lanterns - 5 Years Guarantee
The Following Items are Covered:
- All uPVC trims and claddings free from scratches, blemishes & blistering.
- All powder coated products free from peeling, powdering and blistering.
- The structural integrity of the roof remains stable for a period of 10 years.
- The sealed glass units are guaranteed against failure (inc condensation between the glass units) for a period of 5 years.
- The injection moulded components free from cracks, blemishes and discolouration (except for caramel products).
- Scratches and blemishes are deemed acceptable to Glass and Glazing federation directives, as is visual surface distortion on toughened glass and “haze” on Pilkington “K” glass.
Section 8 - Kitchen Guarantee - 5 Years
8.1. The Supplier Warrants that on Delivery, and for a period of 12 Months from the Date of Delivery (Warranty Period), the Goods shall:
- (a) Conform in all material respects with the Specifications
- (b) be Free from material defects in design, material and workmanship; and
- (c) be of satisfactory quality (within the meaning of the Sale of Goods Act 1979) and suitable for use in a normal domestic family setting.
8.2. Subject to clause 8.3:
- (a) if the Customer gives notice in writing to the Supplier within 7 Business days of the Delivery Date that some or all of the Goods do not comply with the warranty set out in clause 8.1, the Supplier will not accept or consider any complaints reported after this date;
- (b) if the goods are damaged, the Customer must send a photograph to the Supplier and the Supplier will consider whether to send a carrier to collect the Goods if they are damaged; and
- (c) if the Supplier is required to collect the Goods, the Customer will be notified within 5 days of the date the Goods are to be collected; and
- (d) if the supplier is to be given a reasonable opportunity to examine such Goods; and
- (e) it is at the Supplier’s discretion as to whether a handling charge of £200 is charged to the Customer if they return Goods damaged found to be damaged by themselves. If the Goods are in a condition where they cannot be sold, the Goods will be returned to the Customer and the handling charge will be charged; and
- (f) the Goods should be returned in their original packaging; and
- (g) the Customer (if asked to do so by the Supplier) returns such Goods to the Supplier’s place of business at the Customers cost.
- (a) the Customer makes any further use of such Goods after giving notice in accordance with clause 8.2;
- (b) the defect arises because the Customer failed to follow the Supplier’s oral or written instructions as to the storage, comissioning, installations, use and maintenance of the Goods (including all instructions in the technical guide and the door care guide as published by the Supplier) or (if there are none) good trade practice regarding the same;
- (c) the defect arises as a result of the Supplier following any drawing, design or Specification supplied by the Customer;
- (d) the Customer works, alters, tailors or repairs such Goods (including drilling the Goods) without the written consent of the Supplier;
- (e) the defect arises as a result of fair wear and tear, wilful damage negligence, or abnormal storage or working conditions;
- (f) the defect arises as a result of the Customer using the Goods in circumstances, or in an environment, in which the Goods were not intended by the manufacturer of the Goods to operate in; or the Goods differ from their descriptions as a result of changed make to ensure they comply with the applicable statutory or regulatory requirements.
Section 9 - Locks, Hinges, Handles - 3 Years Guarantee
All of The Company products are designed to reduce maintenance but your attention is drawn to the necessity of regular lubrication of moving parts, such as locks, handles & hinges. These should be lubricated with domestic oil or lubricant spray at least once a year, or more frequently as local conditions demand. Any moving parts that are damaged due to negligence will not be covered under this guarantee and the customer may be liable for any costs in replacing such items. The Company have the rights to Charge Materials & Labour in this instance.
Section 10 - Aluminium/uPVC Bi-Fold/Sliding Doors - 5 Years Guarantee
Bi-Folding Doors are Covered for a period of 5 Years from the date of installation. Should your doors become stiff due to adverse weather conditions, A service call may be required to adjust the Doors to rectify the issue. Should you wish to book a Service Call, please send an email with your Issue and we will get this raised with the service call team to get this rectified as quickly as possible for you.
Section 11 - Plastering, Plumbing & Electrics - 1 Year Guarantee
Our Plasterer, Plumber & Electrician have agreed to cover the workmanship that they have carried out during the installation for a maximum term of 1 Year from the date of Install as shown above. Any Wear & Tear, Mis-use or tampering with the installed products are not Permitted or Covered under this or Manufacturer’s Guarantee and may result in a Charge.
Section 12 - Cleaning uPVC Products
Use non-alkaline detergent and warm water; apply to Aluminium / uPVC finishes using a soft cloth or sponge and nothing harsher than a bristle brush or nylon pad should be used. If in doubt, test the cleaner on an unobtrusive area first. Steel wool, strong acids and alkalis, and abrasive cleaners should never be used, The accumulation of atmospheric grime and pollution makes it necessary to clean the surface regularly to maintain its good appearance. it is recommended that cleaning is carried out once every six months. It is quite wrong to assume that if cleaning is carried out less frequently than recommended, the surface of the aluminium or PVC-U can be restored with the occasional use of more aggressive cleaners. Such cleaners could damage the finish, the metal or PVC-U, the glazing sealing systems or even the glass and such a practice should be avoided.
Section 13 - Moving Home / Transfer of Ownership
In the event of a disposal of the property covered by this guarantee, the company will, for a nominal administration fee of £350 +VAT, permit the benefit of the remaining period of this guarantee to be assigned to the new owner of the property & will recognise such new owner as the person entitled to the benefit.
The Company must be advised of the change of ownership within one month from the date of the change. This warranty is from the seller to the buyer and may be transferred to a third party, subject to the following conditions:
- The Company must have full details of third party.
- The actual transfer of property ownership dates.
- That they are in receipt of a Contractor warranty at time of transfer.
- That the old warranty must be surrendered to The Company and we will then issue a new warranty in the new property owner’s name for the duration of time that is remaining on the original warranty.
Section 14 - Guarantee Terms & Conditions
Any Alterations to this guarantee certificate will invalidate the guarantee; this guarantee will be invalid if full payment has not been made prior to any claim; the Guarantee does not provide cover for failure or damage caused by misuse, neglect or lack of maintenance by the user or from causes beyond our control, (for example fire, flooding, civil disturbance, criminal damage or acts of war); this guarantee shall cease if any repairs or changes are made that alters the roof.
